GoDaddy - AI Terms of Use

These terms of use ("AI Terms of Use") govern your use of any AI services and tools offered by GoDaddy or its affiliates (“AI Services”) and apply in addition to GoDaddy’s Universal Terms of Service Agreement, Privacy Policy and all product specific terms. . If you use the AI Services to create a website or content for a website, you agree to the terms of GoDaddy’s Website Services Agreement.

1. GoDaddy claims no intellectual property rights in any user input that you provide to the AI Services or any output generated by the AI Services. GoDaddy also does not review such inputs or outputs, including text, logos, names or slogans, for accuracy, bias or intellectual property rights clearance. You are solely responsible to ensure that you have all rights necessary (including trademark, copyright and other intellectual property rights) to provide your inputs to the AI Services. GoDaddy makes no representation, warranty or guarantee as to the accuracy or reliability of the AI Services or whether such output may infringe on third-party intellectual property rights. You should review the output accordingly and your use thereof is at your sole risk.
2. Outputs may not be unique across users and the AI Services may generate the same or similar outputs for other users.
3. GoDaddy may use technology provided by third-party service providers to provide AI Services. You authorize GoDaddy and such third-party service providers to store and use your input for the purposes of providing you with the AI Services, to review inputs and outputs for abuse or misuse, and to develop and improve the services and products of GoDaddy and such service providers, including as part of the design, training and development process for machine learning models.

All uses of our AI Services must comply with Universal Terms of Service, including the General Rules of Conduct set forth in Section 5. In addition, you hereby represent and agree that you will not use, nor authorize anyone to use on your behalf, the AI Services in a manner (as determined by GoDaddy in its sole and absolute discretion, including, without limitation creating or generating a website or content) that is illegal, or promotes or encourages illegal activity; promotes, encourages, or engages in the exploitation of children, or any activity related to the proliferation of child sexual abuse material (CSAM); promotes, encourages or engages in terrorism, violence against people, animals, or property; promotes, encourages or engages in any spam or other unsolicited bulk email, or computer or network hacking or cracking; violates the Ryan Haight Online Pharmacy Consumer Protection Act of 2008 or similar legislation, or promotes, encourages or engages in the sale or distribution of prescription medication without a valid prescription; violates the Fight Online Sex Trafficking Act of 2017 or similar legislation, or promotes or facilitates prostitution and/or sex trafficking; infringes on the intellectual property rights of any other person or entity; violates the privacy or publicity rights of another User or any other person or entity, or breaches any duty of confidentiality that you owe to another User or any other person or entity; interferes with the operation of the Services; contains or installs any viruses, worms, bugs, Trojan horses or other code, files or programs designed to, or capable of, disrupting, damaging or limiting the functionality of any software or hardware; or contains false or deceptive language, or unsubstantiated or comparative claims, regarding GoDaddy or GoDaddy’s Services.

YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT OUTPUTS OF THE AI SERVICES INCLUDING (WITHOUT LIMITATION) TEXT, LOGOS, NAMES, SLOGANS, HAVE NOT BEEN REVIEWED FOR ACCURACY, BIAS, EXPLAINABILITY OR INTELLECTUAL PROPERTY RIGHTS CLEARANCE. GoDaddy MAKES NO REPRESENTATION, WARRANTY OR GUARANTEE AS TO THE ACCURACY, RELIABILITY, OR ERROR-FREE PERFORMANCE OF THE AI SERVICES, INCLUDING (WITHOUT LIMITATION) WHETHER OUTPUTS MAY INFRINGE, MISAPPROPRIATE OR VIOLATE ANY THIRD-PARTY INTELLECTUAL PROPERTY RIGHTS.

YOU SHOULD SEEK INDEPENDENT PROFESSIONAL LEGAL ADVICE BEFORE YOU RELY ON ANY OUTPUT GENERATED BY THE AI SERVICES.

IN NO EVENT SHALL GoDaddy, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR ANY THIRD-PARTY SERVICE PROVIDERS, BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING ANY THAT MAY RESULT FROM ANY OUTPUTS CREATED USING THE AI SERVICES.

IN ADDITION, YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT IN NO EVENT SHALL GoDaddy’S TOTAL AGGREGATE LIABILITY EXCEED $10,000.00 U.S. DOLLARS.

THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND SHALL SURVIVE ANY TERMINATION OR EXPIRATION OF THIS AGREEMENT OR YOUR USE OF THIS SITE, THE AI SERVICES OR ANY OTHER SERVICES FOUND AT THIS SITE.
