GoDaddy - Online Safety Act Policy

The Online Safety Act 2023 (the "OSA") addresses illegal and harmful content online in the United Kingdom ("UK"). The OSA applies to certain businesses providing online services to their users in the UK, of which includes certain Services provided by GoDaddy . This OSA Policy provides an overview of the types of content that are prohibited on GoDaddy's website (“Site”) and/or the products and services purchased or accessed through this Site (individually and collectively, the “Services”) as well as information on the technical measures that GoDaddy has in place to protect any individual or entity in the UK who accepts the Universal Terms of Service , has access to the individual or entity’s account or uses the Site or the Services (“UK Users”), with helpful links for UK Users to report any illegal or harmful content.

Ofcom is the appointed regulator in the UK to enforce the OSA. Further details are available at: www.ofcom.org.uk

This OSA Policy applies to UK Users only, in respect of the Services in scope under the OSA (see further details below).

Under the OSA, GoDaddy is required to put in place systems and processes to improve online safety for UK Users. GoDaddy monitors its responsibilities and the measures it has in place to minimise the risk of harmful or illegal content being made available to UK Users on the Site and Services. These systems and processes are further detailed below.

GoDaddy does not allow any illegal or harmful content to be shared, transferred or otherwise made available via its Site or Services. Such content is restricted in our [Universal Terms of Service](https://www.godaddy.com/fr-ca/legal/agreements/universal-terms-of-service-agreement. Prohibited Content includes:

• Illegal content includes, but is not limited to, content that is illegal, such as harassment, stalking, controlling or coercive behaviour, certain pornography (including all Child Sexual Abuse Material), hate speech, terrorist content, firearms content and content that encourages or facilitates suicide.
• Harmful content includes, but is not limited to, content that is not illegal but could be harmful or age-inappropriate for children, such as pornographic content, content that promotes, encourages, or provides instructions for suicide, self-harm, or eating disorders, content that depicts or encourages serious violence, and bullying content.

UK Users must not share any Prohibited Content online using the Site and Services. GoDaddy has discretion to determine whether any content on the Site and Services is Prohibited Content. If GoDaddy deems that the content is Prohibited Content, GoDaddy may remove the Prohibited Content from the Site or Services and has the right to suspend or terminate the Services in accordance with the Universal Terms of Service.

GoDaddy has undertaken internal risk assessments of its Services to UK Users as required under the OSA, and has implemented appropriate and proportionate processes, technical measures and staff policies to minimise the risks of potential online harms. GoDaddy will keep these risk assessments updated as required by the OSA.

GoDaddy implements several processes and technical measures to protect UK Users from encountering illegal and harmful content on its Site. These processes and technical measures include removing Prohibited Content where deemed appropriate. GoDaddy also implements specific proportionate measures with the objective of minimising and preventing illegal and harmful content from being accessed by UK Users. These measures are summarised below:

User Generated Content on GoDaddy's Community Boards

• GoDaddy operates a limited service for certain UK Users to ask queries and obtain feedback on the Services via a community board. These community boards are limited services available on a membership only basis (at a cost).
• Content that is posted and shared on these community boards are reviewed in each case and where posts are deemed to have breached the Universal Terms of Service (including the section on Prohibited Content), the content is removed. This measure seeks to minimise the length of time any Prohibited Content is present.
• UK Users can also report any content that they consider may be Prohibited Content by following the GoDaddy content reporting and complaints procedure described below.

GoDaddy Domain Name Search Service

• The domain name search service operated by GoDaddy allows users to search for domain names via the Site. The Site and Services include a search engine that enables UK Users to search for domain name registrations based on their query, account search history, and location. The search engine generates a list of results based on matching between the keywords or character sequences searched and the domain names available for registration.
• The service is a limited "vertical search service" which only allows UK Users to view domain name search results.
• In the very unlikely event that the domain name search results include results that may be linked to Prohibited Content, GoDaddy may remove the Prohibited Content in accordance with the Universal Terms of Service.
• UK users can also report any search results and content that they consider to be Prohibited Content by following the GoDaddy content reporting and complaints procedure described below.

The GoDaddy Digital Crimes Unit seeks to address malicious use of the Site and Services by reviewing reports of abuse and taking appropriate action with the objective of preventing and/or stopping malicious campaigns and/or abusive content on the Site and Services.

UK Users may report to GoDaddy the presence, on the Site or Services, of content that a UK User considers may be Prohibited Content through our Support Center.

When reporting the potentially Prohibited Content, please provide the required details as outlined in our Support Center, so that the GoDaddy team can research your complaint.

If UK Users are unhappy with the way in which GoDaddy has complied with its obligations under the OSA, UK Users can make a complaint to the point of contact below or via our Support Center.

UK Users can use our Support Center to report:

• illegal content on the Sites and Services, or domain name search results
• GoDaddy breaches of the OSA
• complaints against OSA take downs
• complaints against OSA actions taken by GoDaddy, e.g. warnings, suspensions etc.
• complaints against technology used by GoDaddy to comply with the OSA

Freedom of expression is the right to express and receive opinions, ideas and information. GoDaddy is committed to the freedom of its users to express themselves and access information.

GoDaddy also considers that some limitations must apply to the freely available access of information through the Site and Services as required under domestic and international laws, including the OSA and in consideration of protecting Users from Prohibited Content. When limiting UK Users' access to information via the Site and Services, GoDaddy will seek to balance its UK Users' rights to freely access information and express their views against its statutory duties to prevent the sharing of illegal and harmful content. Consequently, GoDaddy may remove and take down certain content (as permitted in the Universal Terms of Service, including, but not limited to, Prohibited Content.

If you have concerns about illegal or harmful content on third-party websites, or such third-party website provider's compliance with the OSA or other applicable laws, you should contact the provider of such website.

Where GoDaddy provides services to the provider of such websites (such as hosting and domain name registration services), GoDaddy does not control or "provide" these websites and does not have control over the content on such sites, and so is not legally responsible for such website provider's compliance with the OSA. However, you may still be able to raise certain concerns and report certain issues to GoDaddy via our Support Center.
