1. THE PROMOTER
The promoter is GoDaddy.com LLC (100 S. Mill Ave., Suite 1600, Tempe, AZ 85281) ("GoDaddy").
2. THE COMPETITION
2.1 These terms and conditions govern the Go Fund Kickstarter competition (the "Competition") being run by GoDaddy in the United Kingdom.
2.2 The Competition will lead to one winner being chosen in accordance with these terms and conditions. The winner will be awarded £10,000 in prize money for the purposes of launching their proposed start-up business.
2.3 All participants in the Competition are deemed to have agreed to be bound by these terms and conditions.
3. ELIGIBILITY
3.1 All participants must be individual's resident in the UK (with a UK bank account) and proposing a start-up business idea ("Business Idea").
3.2 To be eligible for the Competition, you must not have already launched, nor be operating (in whole or in part) your Business Idea using an existing dedicated domain (this does not include social media channels).
3.3 The following are not permitted to participate in the Competition:
3.3.1 any individual under the age of 18;
3.3.2 any employees of GoDaddy or its holding or subsidiary companies; or
3.3.3 any members of the immediate families or households of GoDaddy employees who are professionally connected with the Competition or its administration.
3.4 By participating in the Competition, all participants confirm that they meet the eligibility requirements outlined above. GoDaddy may require participants to provide proof of eligibility to participate in the Competition.
3.5 GoDaddy reserves all rights to disqualify any participant if their conduct is contrary to the spirit or intention of the Competition.
4. HOW TO PARTICIPATE
4.1 The Competition will run from 12 noon on 3rd July 2024 (the "Opening Date") to 11:59pm on 5th August 2024 (the "Closing Date") inclusive.
4.2 All Competition entries received after the Closing Date are automatically disqualified.
4.3 To participate in the Competition, individuals are required to:
4.3.1 click on the following link https://www.surveymonkey.com/r/P9PLY6X and provide the following information/answer the following questions (as relevant) via Survey Monkey;
4.3.1.1 name;
4.3.1.2 email address;
4.3.1.3 contact number;
4.3.1.4 what is the name of your Business Idea;
4.3.1.5 tell us about your Business Idea in three sentences; and
4.3.1.6 what you would like your new business domain name to be (please use ".store"),
4.3.2 click "submit" prior to leaving/closing down the relevant webpage.
4.4 No purchase is necessary to enter the Competition.
4.5 GoDaddy will not accept entries that are:
4.5.1 automatically generated by computer;
4.5.2 completed by third parties or in bulk;
4.5.3 incomplete or illegible; or
4.5.4 not received by the deadline.
4.6 GoDaddy will not amend any contact information once a Competition entry has been submitted.
4.7 There is a limit of one entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
4.8 GoDaddy will not accept:
4.8.1 responsibility for entry information that is lost, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
4.8.2 proof of transmission as proof of receipt of entry information.
5. GO FUND KICKSTARTER WINNER
5.1 All entries received by the Closing Date will be entered into the Competition draw. The winner will be selected at random, and will be verified to ensure they meet:
5.1.1 the eligibility requirements set out in section 3 of these terms and conditions; and
5.1.2 the information requirements set out in section 4.3 of these terms and conditions,
(the "Entry Requirements").
5.2 In the event a winning entry does not meet the Entry Requirements, a new winner will be selected at random until an entry is selected which does.
5.3 The decision of GoDaddy is final and no correspondence or discussion will be entered into.
5.4 GoDaddy (or its partner The Fitting Room, Unit G06-08, The Shepherds Building, Charecroft Way, London, W14 0EE ("TFR") acting on GoDaddy's behalf) will make reasonable efforts to contact the winner personally as soon as practicable, using the telephone number or email address provided with the competition entry.
5.5 The winner must respond to our attempts to contact them within a reasonable time period (within at least 30 days) and provide us with their UK bank account details in order to allow us to award the prize. The winner must also provide any further information/complete any relevant paperwork as required to allow us to award the prize.
5.6 By entering the competition, you are providing us with all necessary consents to share your contact name, number and bank details with our partner TFR (as TFR will make arrangements for the prize to be paid to the winner on our behalf).
5.7 In the event the selected winner cannot be contacted within a reasonable time and using reasonable efforts (or the winner fails to provide the information needed/complete any relevant paperwork required to award the prize), GoDaddy reserve the right (but is not under any obligation) to select a new winner at random, and in such circumstances, the original winner will forfeit the prize.
5.8 GoDaddy does not accept any responsibility if a winner is not able to take up the prize.
5.9 The prize may not be claimed by a third party on a winner's behalf. The prize is not negotiable or transferable.
5.10 GoDaddy must either publish or make available information that indicates that a valid award took place. To comply with this obligation, GoDaddy will make all reasonable efforts to publish the surname and county of the winner, as well as details of their Business Idea on GoDaddy UK's Blog page (Homepage - GoDaddy Resources - United Kingdom) within three months after the Closing Date of the Competition.
5.11 If you object to any or all of your surname, county and/or details of your Business Idea being published or made available as detailed above, please contact GoDaddy at gsmedley@godaddy.com. In such circumstances, we must still provide the information and winning entry to the Advertising Standards Authority on request.
6. DISCLAIMERS
6.1 Insofar as is permitted by law, GoDaddy, its agents, partners and distributors will not in any circumstances be responsible or liable to compensate the winner or any participants or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize or participating in the Competition (except where it is caused by the negligence of GoDaddy, its agents or distributors or that of their employees). Your statutory rights are not affected.
6.2 Save for the Competition questions, we have no control over the Survey Monkey website and accept no legal responsibility for any content, material or information contained or linked as part of it. The display of a website and and/or a hyperlink in these terms and conditions (or on our social media channels) does not mean that we endorse that third parties' website, products or services. Your use of the Survey Monkey website may be governed by terms and conditions relevant to that website.
6.3 GoDaddy cannot, in any way, guarantee the availability of your preferred new business domain.
6.4 GoDaddy reserves the right to void, amend, and/or change this Competition at any time without incurring any liability whatsoever where it becomes reasonably necessary to do so.
6.5 GoDaddy reserves the right to request further information from participants to ensure compliance with these terms and conditions and to request additional information and supporting documents.
6.6 GoDaddy reserves the right to exclude participants if it suspects that the Competition is being abused in any way. GoDaddy's decisions in relation to the Competition are final and no correspondence will be entered into.
6.7 GoDaddy reserves the right to require the full or part reimbursement of the prize if GoDaddy has reasonable grounds to conclude that the prize has not been used for the sole purpose of launching the winner's Business Idea (and/or related domain).
7. PRIVACY
The Promoter will only process your personal information as set out in Privacy Agreement - GoDaddy UK.
8. OTHER IMPORTANT TERMS
8.1 If GoDaddy becomes aware of any breach of these terms and conditions (including any fraudulent behaviour), it shall be free to (i) seek the reimbursement of the prize if already paid to a participant and/or (ii) take any legal action against any participants involved.
8.2 Any tax consequences related to the Competition will be participant's sole responsibility.
8.3 These terms and conditions are governed by the laws of England and Wales. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts of England and Wales.
